Al formular nuestras teorías, recurrimos a lenguajes exactos que nos permiten minimizar la vaguedad y expresarnos lo más precisa y cuantitativamente posible. Recurrimos a la matemática. Cuando formulamos nuestras teorías fácticas en lenguaje matemático, estas se refieren no solamente a objetos (...) que nosotros interpretamos como materiales, tales como partículas o personas, sino también a entidades más raras de un mundo abstracto: conjuntos, números, funciones, espacios algebraicos, variedades, topologías, y otras entidades similares. There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

Principale artefice della diffusione del pensiero di Hans Kelsen nella cultura giuridica italiana, Norberto Bobbio ha riflettuto sulle opere del giurista austriaco fin dall’inizio del suo percorso accademico. Dapprima considerata criticamente, la dottrina pura del diritto divenne per lui, nel secondo dopoguerra, il punto di riferimento di un progetto di rinnovamento che mirava a rendere scientifiche la filosofia e la teoria del diritto, svincolandole da approcci metafisici e ideologici. La convinta difesa delle idee kelseniane non impedì tuttavia, a Bobbio, (...) di vederne anche i limiti e di leggerne criticamente i fondamenti. Le riflessioni sulla stretta connessione tra teoria della norma e teoria dell’ordinamento, sulla norma fondamentale, sulla funzione delle norme, sulla connessione tra giurisprudenza e metagiurisprudenza segnano alcune significative innovazioni suggerite da Bobbio ai cultori della teoria generale del diritto muovendo proprio da una lettura criticamente attenta delle opere kelseniane. Ma soprattutto, l’insistenza sul nesso tra diritto e potere come questione ineludibile della stessa teoria del diritto individua lo spazio nel quale il pensiero di Bobbio rivendica una sua autonoma originalità rispetto a quello di Kelsen, permettendo altresì di segnalare il sostrato ideologico della teoria pura del diritto. Il presente volume raccoglie i saggi dedicati da Bobbio alla teoria giuridica del grande pensatore austriaco. Essi si collocano nel contesto di un dialogo costante con le opere di Kelsen che ha lasciato traccia, oltre che nella teoria del diritto, anche nella teoria della democrazia e nel pacifismo giuridico del filosofo torinese. Este trabajo se propone dos objetivos, uno descriptivo y otro propositivo. El descriptivo consiste en el análisis de la crítica que realiza E. Cioran, a lo largo de su obra, a la concepción humanista del ser humano Nuestro filósofo pone en cuestión la arrogancia del hombre que se coloca en el lugar fundamental y de supremacía en el ámbito de la vida, lugar que le sirve de justificación para conquistar, apropiarse y aniquilar a la naturaleza y al resto de los (...) vivientes. Por otro lado, en términos propositivos, me interesa plantear la cuestión de la animalidad(el animal que es el ser humano, y los animales no humanos) porque permite poner en cuestión esa concepción humanista, y pensar nuevos modos de ser-con lo viviente. En este sentido, sostengo a lo largo del trabajo que la filosofía de Cioran permite pensar una noción de lo humano atravesada por la animalidad, noción cioraneana que desarma("descompone") la arrogancia de los humanismos. Para ello me serviré de la problemática de la muerte como inmanente a la vida y de la crítica de Cioran a la noción de propiedad. (shrink)

The concept of ideology is central to the understanding of the many political, economic, social, and cultural processes that have occurred in the last two centuries. And yet, what is the nature of the different ideologies remains a vague, open, and much disputed question. Many political, sociological, and ideological studies have been devoted to ideology. Very little, on the other hand, has been done from the philosophical field. And this despite the fact that there are undoubtedly many philosophical questions related (...) to ideology and its role in modern industrialized societies. Just a few examples of ideology-related philosophical questions suffice to prove the point: What objects do ideologies deal with? Are the ideologies testable? Are there true ideologies? Do they evolve? How are ideologies related to societies? Is the existence of ideologies inevitable in modern societies? What is the relation of ideology to science? Is science just another kind of ideology? Are we, as human beings, innately predisposed to believe in ideologies? Or, instead, ideologies proliferate through indoctrination and propaganda? Are ideologies necessarily harmful?...and much more. In this article I try to answer some of these questions from a philosophical point of view, taking a materialist approach. I begin by characterizing ideology as a complex, multi-layered concept. Then, I briefly discuss the material systems on which ideological movements operate, that is, societies and concrete human groups. I identify at least 11 different elements that seem to be present in most ideologies, and I compare these characteristics with those of contemporary science and technology. Although some superficial similarities can be identified, there are deep differences that make ideology completely different from science. The similarities, however, are stronger with technology. Ideologies continually evolve with technological advances, social changes, and even with mere fashion. The current fragmentation of ideologies caused by the widespread use of new technologies and social networks has given rise to new phenomena of ideological propagation which, in my opinion, are very dangerous, particularly for open societies. I discuss these processes, within the context of the nature vs nurture debate, along with the question of whether we can get rid of ideologies. (shrink)

Purpose– The purpose of this paper is to introduce the term Slow Tech as a way of describing information and communication technology that is good, clean and fair. These are technologies that are human centred, environmentally sustainable and socially desirable.Design/methodology/approach– The paper's approach is based on a qualitative discourse that justifies the introduction of Slow Tech as a new design paradigm.Findings– The limits of the human body, and the need to take into account human wellbeing, the limits of the planet (...) and stakeholders' interests in decision making, all suggest the need for a new paradigm, Slow Tech, in the design of ICT and ICT systems. Three scenarios are described as case studies.Practical implications– In order to prepare the next generation of researchers and computer professionals, many different actions need to be taken. Universities and colleges need to redesign education programmes for computer scientists and engineers by introducing subjects related to the social and ethical implications of computing, and computer professionals' associations need to introduce a code of ethics or ethical analysis into their members' career development. As a result, future computer professionals who are familiar with the Slow Tech approach will be able to collaborate much more easily across the kind of cross disciplinary teams suited to design human centred, sustainable and desirable technologies.Social implications– Rather than simply focusing on the role of computer professionals, all members of society are called to play a new role in the design of future ICT scenarios. Starting a societal dialogue that involves computer professionals, users, researchers, designers, ICT industrialists, and policy makers is very much needed.Originality/value– The value of this paper is in its call for reflection followed by action. Based on an holistic approach to the design of new ICT systems, the paper advocates a new starting point for systems design: it should be based on a long-term view of the desirability and social importance of technologies, their environmental impact and sustainability, and the fairness and equity of the conditions of workers involved in the computing manufacturing processes. Dung’s argumentation frameworks have been applied for over twenty years to the analysis of argument justification. This representation focuses on arguments and the attacks among them, abstracting away from other features like the internal structure of arguments, the nature of utterers, the specifics of the attack relation, etc. The model is highly attractive because it reduces most of the complexities involved in argumentation processes. It can be applied to different settings, like the argument evaluation of an individual agent or the (...) case of dialectic disputes between two agents (pro and con), or even in multi-agent collective argumentation. The latter case involves agents with possibly different arguments and/or opinions on how to evaluate them, leading to the possibility of considering multiple sets of arguments and attack relations. Two basic questions can be asked here, namely ‘what to aggregate’ and ‘how to aggregate’. The former concerns what kinds of entities do the agents intend to choose (arguments, attacks, assessments, etc.), while the second one focuses on which aggregation mechanisms yield rational choices (voting on arguments, merging procedures to obtain a common argumentation framework, deliberation processes, etc.). In particular, the question about the rationality of a collective argument choice relates this topic to Social Choice and Judgment Aggregation theories, while its associated strategic issues relate it to Game Theory. The research efforts on the disparate problems elicited by collective argumentation have generated a considerable corpus of literature that deserves an orderly evaluation. ABSTRACTContrary to what some critics of epistemic democracy claim, the association between democracy and truth does not necessarily make the former inhospitable to conflict, contestation, and pluralism. With the help of John Stuart Mill and William James, truth can be interpreted so as to make it compatible with a democratic politics that appreciates conflict and dissent. In some circumstances, truth claims are politically relevant and should become the object of democratic deliberation.

The problems that arise from the presence of self-attacking ar- guments and odd-length cycles of attack within argumentation frameworks are widely recognized in the literature on defeasible argumentation. This paper introduces two simple semantics to capture different intuitions about what kinds of arguments should become justified in such scenarios. These semantics are modeled upon two extensions of argumentation frameworks, which we call sustainable and tolerant. Each one is constructed on the common ground of the powerful concept of admissibility introduced by (...) Dung in [10]. The novelty of this approach consists in viewing the admissibility of a subset of arguments as relative to potentially challenging subsets of arguments. Both sustainable and tolerant semantics are more credulous than preferred semantics (i.e. they justify at least the same arguments, and possibly more). Given certain sufficient conditions they coincide among them as well as with other semantics introduced by Dung. (shrink)

I offer a theory of art that is based on science. I maintain that, as any other human activity, art can be studied with the tools of science. This does not mean that art is scientific, but aesthetics, the theory of art, can be formulated in accord with our scientific knowledge. I present elucidations of the concepts of aesthetic experience, art, work of art, artistic movement, and I discuss the ontological status of artworks from the point of view of scientific (...) philosophy. No pensamento dos três autores, democracia, liberdade e desenvolvimento de si constituem uma tríade de mútua influência, de sorte que o pleno exercício de quaisquer desses itens é impossível na ausência de qualquer um dos outros dois. Trata-se de mostrar, além disso, a maneira pela qual a (...) opressão é compreendida nos trabalhos dos três pensadores como o oposto da liberdade, e a injustiça epistêmica, como uma dimensão psíquica da opressão. In this paper we provide a compact presentation of the verisimilitudinarian approach to scientific progress (VS, for short) and defend it against the sustained attack recently mounted by Alexander Bird (2007). Advocated by such authors as Ilkka Niiniluoto and Theo Kuipers, VS is the view that progress can be explained in terms of the increasing verisimilitude (or, equivalently, truthlikeness, or approximation to the truth) of scientific theories. According to Bird, VS overlooks the central issue of the appropriate grounding of scientific (...) beliefs in the evidence, and it is therefore unable (a) to reconstruct in a satisfactory way some hypothetical cases of scientific progress, and (b) to provide an explanation of the aversion to falsity that characterizes scientific practice. We rebut both of these criticisms and argue that they reveal a misunderstanding of some key concepts underlying VS. (shrink)

In his autobiographical sketch, the author surveys sixty years of legal philosophy. He traces the major changes that have come about in the philosophy of law in the wake of the Second World War, and the gap which has been bridged between Continental and Anglo‐Saxon theories. The values of liberal democracy and the acknowledgement of human rights have helped to circumvent the gulf between natural law theories and legal positivist theories.

A theoretical framework for the reinforcement learning of aesthetic biases was recently proposed based on brain circuitries revealed by neuroimaging. A model grounded on that framework accounted for interesting features of human aesthetic biases. These features included individuality, cultural predispositions, stochastic dynamics of learning and aesthetic biases, and the peak-shift effect. However, despite the success in explaining these features, a potential weakness was the linearity of the value function used to predict reward. This linearity meant that the learning process employed (...) a value function that assumed a linear relationship between reward and sensory stimuli. Linearity is common in reinforcement learning in neuroscience. However, linearity can be problematic because neural mechanisms and the dependence of reward on sensory stimuli were typically nonlinear. Here, we analyze the learning performance with models including optimal nonlinear value functions. We also compare updating the free parameters of the value functions with the delta rule, which neuroscience models use frequently, vs. updating with a new Phi rule that considers the structure of the nonlinearities. Our computer simulations showed that optimal nonlinear value functions resulted in improvements of learning errors when the reward models were nonlinear. Similarly, the new Phi rule led to improvements in these errors. These improvements were accompanied by the straightening of the trajectories of the vector of free parameters in its phase space. This straightening meant that the process became more efficient in learning the prediction of reward. Surprisingly, however, this improved efficiency had a complex relationship with the rate of learning. Finally, the stochasticity arising from the probabilistic sampling of sensory stimuli, rewards, and motivations helped the learning process narrow the range of free parameters to nearly optimal outcomes. Therefore, we suggest that value functions and update rules optimized for social and ecological constraints are ideal for learning aesthetic biases. (shrink)

Theory change is a central concern in contemporary epistemology and philosophy of science. In this paper, we investigate the relationships between two ongoing research programs providing formal treatments of theory change: the (post-Popperian) approach to verisimilitude and the AGM theory of belief change. We show that appropriately construed accounts emerging from those two lines of epistemological research do yield convergences relative to a specified kind of theories, here labeled “conjunctive”. In this domain, a set of plausible conditions are identified which (...) demonstrably capture the verisimilitudinarian effectiveness of AGM belief change, i.e., its effectiveness in tracking truth approximation. We conclude by indicating some further developments and open issues arising from our results. (shrink)

The body of Eva in Thomas Aquinas The constitution of the first female body or the body of Eva presents several physical and metaphysical problems, problems that have gone through the centuries and reach the present, generating social and cultural consequences for women. The non-existence of parents demands from Aquino answers that go beyond the anthropological and biological and lead to the search of philosophical answers intertwined with the theological ones. Thomas Aquinas provides rational answers although the background is of (...) faith, and even, with literal interpretations of the Sacred Scriptures now abandoned. The Aquinate makes an intellectual effort to find answers in a rational field because the matter of the body of the first woman brings difficulties for its elucidation and understanding. As in other parts of his extensive work, Thomas Aquinas, follows the biological and physical works of Aristotle. Although the Aristotelian background is in line with Christian thought, Aquinas shows his extraordinary capacity for synthesis between the faith received and reason argued, between revelation and the principles of reason. Micro Credit (MC) programs lend money to poor borrowers using innovative mechanisms such as group lending under joint liability while successfully accounting for the presence of asymmetric information in underdeveloped financial markets. MC programs have achieved what the conventional financial institutions and the government have not been able to: lend to the poor, impressive loan recuperation, and a positive impact in poverty reduction. This article analyzes the performance of ALSOL, an MC program in Chiapas, México, for 2151 participants in urban (...) and rural areas for the time period between July 2000 and July 2001. While loan recuperation is high (95%), administrative costs also remain high. Socially responsible lenders and donors play a key role in providing continuous funding to MC programs and assisting in reducing the level of poverty. (shrink)

Con ese propósito, el jurista identifica los diferentes modelos de readaptación social (“readaptación para la moralidad” y “readaptación para la legalidad”), con sus virtudes y críticas. Por último, Arocena examina los condicionamientos que impone un arquetipo de Estado social y democrático de Derecho, a la hora de adherir a uno u otro de esos modelos, y (...) finalmente expone sus razones a favor de un paradigma de readaptación social mínimo. This paper questions the notion that states may be justified in denying certain prisoners the right to vote as a means of distancing themselves from particularly grave wrongs. Christopher Bennett has recently defended prisoner disenfranchisement as a fair and deserved retributive punishment for crimes, and Mary Sigler and Andrew Altman have argued in favor of prisoner disenfranchisement as a civil restriction. All three proponents agree that disenfranchisement should be reserved for those guilty of the most serious offenses. I assert that (...) it is inappropriate to treat citizens in this manner and will advocate for the right to vote, whether disenfranchisement is perceived as a form of punishment or as a civil measure. I will present two arguments against disenfranchisement as it impacts both citizens and political community at large. First, it excludes citizens from the democratic arena and restricts the opportunity to reintegrate offenders into the political community. While a criminal sentence is intended to be burdensome, the burden associated with disenfranchisement extends beyond the appropriate penal scope. (shrink)

Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. The outcome is that conceptual engineering should be all about concepts on pain of pragmatic inconsistencies otherwise. (shrink)
